Website Terms & Conditions — Fluid Business Advisory
These Terms govern access to and use of websites, portals and online services operated by Counting House Associates Pty Ltd trading as Fluid Business Advisory ACN 159 770 279 (collectively, Site). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
About us & professional status
We are an Australian professional services firm providing accounting, tax, audit and advisory services. Liability limited by a scheme approved under Professional Standards Legislation. Our professional engagement terms govern the provision of services to clients and prevail over any inconsistent Site content.
Access & acceptable use
You must use the Site lawfully and not: (a) interfere with or disrupt the Site or networks; (b) attempt unauthorised access; (c) introduce malware or harmful code; (d) use the Site to transmit unlawful, defamatory, offensive or infringing content; or (e) scrape, harvest or mine data without our prior written consent. We may suspend or terminate access if we reasonably believe you have breached these Terms.

Content is general information only and not professional advice. Obtain appropriate advice before acting. While we try to keep content current, we do not warrant accuracy, adequacy or completeness and are not responsible for loss arising from reliance.
Accounts, security & client portals
If you create an account or access a client portal, you are responsible for your credentials and all activity under your account. Notify us immediately of any unauthorised use. We may require multi-factor authentication and other controls.
Privacy, cookies & electronic marketing
Our Privacy Policy explains how we handle personal information and cookies. We comply with the Spam Act 2003 (Cth) for electronic marketing; unsubscribe options are provided.
Intellectual property

You may view and print content for personal, non-commercial use with proprietary notices intact. Third-party websites, plug-ins and tools are not under our control. We are not responsible for their content, privacy practices or availability. Access is at your own risk and subject to third-party terms.

If you upload, post or submit material to the Site or a client portal, you warrant you have rights to do so and that it is accurate, lawful and not misleading. You grant us a non-exclusive licence to use that material solely to operate the Site, deliver services or as otherwise agreed with you. We may remove material that appears to breach these Terms.
Consumer guarantees & disclaimers
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded (Non-Excludable Rights). Subject to the Non-Excludable Rights and to the maximum extent permitted by law, the Site and content are provided “as is” and we exclude all other warranties, representations and guarantees.
Limitation of liability
Subject to the Non-Excludable Rights and to the maximum extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, revenue, data, or business interruption in connection with the Site or these Terms. Where liability for services can be limited under the Australian Consumer Law, our liability is limited (at our option) to resupplying the services or paying the cost of having the services supplied again.
Indemnity
You indemnify us and our partners, employees and agents against loss, liability, cost, expense or claim arising from your breach of these Terms or misuse of the Site.
Availability, changes & suspension
We do not guarantee continuous availability. We may change or suspend the Site or these Terms at any time without notice.
Notices of copyright infringement
If you believe Site content infringes your copyright, contact us with details of the work, the allegedly infringing material and your contact details. We will investigate and take appropriate action.
Governing law
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
